Allgemeine Geschäftsbedingungen

Angebote über Catering-Leistungen, die Raummiete oder die Nutzung des „Chef´s Table“ von „TheGreatRoom“ (TGR) sind freibleibend und unverbindlich. Vertragsschluss und Einverständnis mit den Vertrags- und Ausführungsbedingungen erfolgen mit schriftlicher Auftragsbestätigung des Kunden zum Angebot von TGR.

Spätestens 5 Werktage vor Veranstaltungsbeginn hat der Kunde die genaue Teilnehmerzahl schriftlich mitzuteilen. Die Angabe ist verbindlich und kann bis spätestens 3 Werktage vor Beginn der Veranstaltung in Abstimmung mit TGR um maximal 5 % der ursprünglich angegebenen Personenzahl modifiziert werden. Sollte eine größere Modifizierung der Teilnehmeranzahl vom Kunden gewünscht werden, muss TGR eine Aufwandspauschale in Höhe der u. g. Stornogebühren pro Person berechnen.

Im Einklang mit den Richtlinien der Lebensmittelhygieneverordnung und zur Gewährleistung der Qualität ist die Buffet-Standzeit auf max. 3 Stunden begrenzt. Falls eine Buffet-Standzeit für einen längeren Zeitraum benötigt wird, kann die Gesamtmenge nach Absprache in verschiedenen Zeitfenstern ausgeliefert und so über einen längeren Zeitraum ausgedehnt werden.
TGR übernimmt keine Haftung für Verlust oder Beschädigung eingebrachter Sachen, es sei denn, es liegt grob fahrlässiges oder vorsätzliches Verhalten von TGR und seiner Mitarbeiter vor. Nach Übergabe oder Abnahme durch den Kunden gehen Risiko und Haftung für Verlust oder Beschädigung auf den Kunden über. Der Kunde erklärt sich mit der vertraulichen Speicherung der geleisteten Angaben und Daten zum Zwecke der Veranstaltung einverstanden.

Abrechnungsgrundlage ist die von dem Kunden angegebene und ggf. modifizierte Teilnehmerzahl bzw. die verbindlich bestellten Mengen.

Alle Preise verstehen sich in Euro und zuzüglich der gesetzlichen Mehrwertsteuer in Höhe von derzeit 19 %. Bei Auftragserteilung für Caterings ist eine Anzahlung in Höhe von 50 % vom Auftragswert fällig. Der restliche Rechnungsbetrag ist vom Kunden innerhalb von 7 Tagen nach Rechnungseingang auf das Konto von TGR zu überweisen.

Die Abrechnung für die Kaltgetränke erfolgt stets nach dem tatsächlichen Verbrauch, es sei denn, es sind vorab verbindliche Mengen ausdrücklich vereinbart worden. Falls eine Begrenzung für den Getränkeausschank gewünscht wird, ist dies bei Auftragserteilung anzugeben.

Stornofristen und -gebühren gelten wie folgt:
Vertragskündigung bis 31 Werktage vor Veranstaltungsbeginn: 10 % der Auftragssumme
Vertragskündigung 16-30 Werktage vor Veranstaltungsbeginn: 25 % der Auftragssumme
Vertragskündigung 11-15 Werktage vor Veranstaltungsbeginn: 50 % der Auftragssumme
Vertragskündigung 6-10 Werktage vor Veranstaltungsbeginn: 75 % der Auftragssumme
Vertragskündigung 0-5 Werktage vor Veranstaltungsbeginn: 100 % der Auftragssumme

Verzögerungen des Liefer- und Leistungsumfangs aufgrund von höherer Gewalt oder nicht durch TGR beeinflussbaren Faktoren wie Streik, Demonstrationen, behördlichen Anordnungen etc. sind nicht von TGR zu vertreten oder zu verantworten.

Gerichtsstand ist Berlin, Bundesrepublik Deutschland.

Teilunwirksamkeit einer Bedingung führt nicht zur Gesamtunwirksamkeit des Vertrages.

General Terms and Conditions

Offers for catering services, location rent or use of the “Chef’s Table” at “TheGreatRoom” (TGR) are not binding. Conclusion of contract and agreement to its provisions result from the client’s written order confirmation regarding TGR’s offer.

The client shall report the exact number of participants 5 business days prior to the beginning of the event at the latest. This declaration is binding and may be modified by 5% of the original number of participants up to 3 business days prior to the beginning of the event in coordination with TGR. In case a greater modification of the number of participants is wished by the client, TGR shall invoice a lump sum equalling the total amount of cancellation fees per person named below.

According to applicable food hygiene regulations and for quality assurance, the period of time food may be left out on a buffet is limited to 3 hours. In case the buffet is needed for a longer period, the total amount of food can also be delivered in several batches upon request.

TGR does not assume any liability for loss or damage of personal items, unless caused by intentional or grossly negligent acts of TGR or its staff. After any personal items have been handed over to and accepted by the client, all risk and liability for any loss or damages are devolved to the client. The client agrees to the confidential storage of any personal details and data provided for the purpose of the event.

The final price is based on the number of participants provided or modified by the client and the bindingly ordered quantities.

Our prices are calculated in Euro and do not include the German sales tax (currently 19%). In case of catering contracts, TGR will require an advance payment of 50% of the contract value. The remaining invoice amount shall be paid by bank transfer to TGR’s bank account within 7 days after the invoice is received by the client.

The final invoice for cold drinks always refers to the actual consumption, unless a binding total amount has been expressly agreed in advance. In case the client wishes to limit the quantity of drinks served, this has to be expressly stated by the client at the time of entering into the contract.

Below please find our valid cancellation periods and fees:
Termination of contract until 31 business days prior to the event: 10% of the contract amount
Termination of contract 16-30 business days prior to the event: 25% of the contract amount
Termination of contract 11-15 business days prior to the event: 50% of the contract amount
Termination of contract 6-10 business days prior to the event: 75% of the contract amount
Termination of contract 0-5 business days prior to the event: 100% of the contract amount

TGR shall not be liable for delays in delivery and/or performance due to acts of God or any other event beyond the control of TGR, including, but not limited to strikes, demonstrations, official orders etc.

Place of jurisdiction is Berlin, Federal Republic of Germany.

Partial invalidity of one term shall not entail the complete invalidity of the contract.
